1. Who we are

These services are provided by Tours and Activities Marketplace Inc., a company incorporated in the United States, Federal Tax ID (EIN) 42-4554164, with mailing address at 153 E Flagler St #1120, Miami, FL 33131, United States.

2. Services provided

TAM operates a B2B platform for the distribution of tours, activities and attractions, including API integration, white-label solutions, localised content and managed operations (onboarding, curation, post-sales and settlement).

The website itself is informational. It does not sell experiences to consumers and does not process payments.

3. Eligibility

Our services are addressed to companies and organisations. By contacting us or contracting with us you represent that you are authorised to act on behalf of your company and that the information you provide is truthful and complete.

4. Use of the platform

• You will use the platform only for lawful purposes and in accordance with applicable law.
• Unauthorised access, misuse, scraping or any attempt to interfere with the operation of the platform is prohibited.
• You must protect your credentials and notify us immediately of any suspected unauthorised use.

5. Commercial terms

We do not charge integration fees for standard connectivity. Commissions, net rates and any other commercial condition applicable to bookings are set out in the specific contract or commercial agreement between the parties, which prevails over this document.

6. Intellectual property

Text, images, trademarks, software and other content are the property of Tours and Activities Marketplace Inc. or of their respective owners and are protected by intellectual property law. Reproduction or distribution without authorisation is not permitted.

7. Intermediation and liability

Tours and Activities Marketplace Inc. acts exclusively as a technology platform and commercial intermediary connecting distributors, agencies and travel companies with official suppliers of tours, activities and attractions. Each experience is operated and delivered directly by its corresponding supplier.

Performance of the service is entirely the supplier's responsibility. TAM is not liable for cancellations, no-shows, operational incidents, weather conditions, delays or any other event outside its control.

8. Cancellations and refunds

Cancellations and refunds are governed by the applicable supplier's policy. TAM may assist in managing the process between the parties, with no obligation to refund on its own account unless expressly agreed.

9. Data protection

We process personal data as described in our Privacy Policy. Where data of individuals located in the European Economic Area or Brazil is processed, our affiliated entities apply the GDPR and the LGPD respectively.

10. Term and termination

We may suspend or terminate access for breach of these Terms, of the applicable contract, or where required by law. Obligations that by their nature survive termination will remain in force.

11. Governing law and jurisdiction

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law rules. The parties submit to the courts located in Miami-Dade County, Florida, except where mandatory law provides otherwise.

12. Changes

We may update these Terms to reflect legal or operational changes. The version in force will always be available on this page.
